In Article 12 of the Turkish Citizenship Law (No. 5901) under the heading “Exceptional circumstances in the acquisition of Turkish citizenship”; in accordance with subparagraph (j) of paragraph 1 of Article 31 of the Foreigners and International Protection Law (6458), foreign nationals who hold a residence permit / residence permit and Turquoise Card holders and their foreign national spouse, his / her spouse under the age of 18 (non-adult) or it is foreseen that foreign children over the age of 18 who are dependent on them can acquire Turkish citizenship, provided that they do not have any obstacle in terms of the security and public order of Turkey and by the decision of the President.

In Article 20 of the Regulation on the Implementation of the Turkish Citizenship Law prepared on the basis of Article 46 of the Turkish Citizenship Law (No. 5901) titled “Acquisition of Turkish citizenship exceptionally, the documents required for the application and the procedures to be done”; there are expressions that foreign nationals, whose status of employment for at least fifty (50) people is determined by the Ministry of Family, Labor and Social Services, can acquire Turkish citizenship by the President’s decision within the scope of the clause (b) of the first paragraph in Article 12 of the Law No. 5901.

On the other hand, in the sub-clause (j) of the first paragraph of Article 31 of the Law on Foreigners and International Protection (No. 6458); Those who do not work in Turkey but will invest in the scope and amount of the investment determined by the Article 20 titled “Regulation on the Implementation of the Turkish Citizenship Law”, “The exceptional acquisition of Turkish citizenship, the documents required for this application and the transactions to be made” and their foreign national spouse it is stipulated that he/she and his/her spouse may be granted a residence permit for a maximum of 5 (five) years to foreign dependent children who are under 18 (minor) or over 18.

Based on the provisions of all the legislation mentioned above, the residence permit to be made by foreign nationals to the Ministry of Internal Affairs within the scope of Article 31 / j of the Law No.6458 the request for a certificate of conformity, indicating that it employs at least 50 (fifty) people, is evaluated within the framework of the following procedures and principles.

Application and Evaluation Process

Foreigners, who have requested a certificate of conformity on the grounds that they employ at least 50 Turkish citizens, apply in writing to the General Directorate of International Labor, which is affiliated with the Ministry of Family, Labor and Social Services, with the following documents.

Applications are evaluated by the General Directorate of International Labor, affiliated with the Ministry of Family, Labor and Social Service. Applications without any deficiencies are finalized within 7 working days. In applications made with missing information or documents, thirty (30) days is given to the applicant to complete the detected deficiency. If the deficiency is not resolved within this period, the application is rejected.

As a result of the evaluation, the application results regarding foreigners who are determined to meet the required conditions are notified to the Ministry of Interior and also to the applicant.

Required Documents for Application

• The application petition signed personally, with wet signature, by the applicant foreign national real person.
• Certified signature declaration of the foreign applicant, received from a notary public, with wet signature.

• Photocopies of all processed pages of the person’s passport containing identification information.
• Trade registry gazette records showing the partnership and capital shares of companies and / or companies employing at least fifty (50) Turkish citizens in total, and the date-to-date Trade Registry Certification.
• The updated Workplace Employee List taken from the SSI Social Security Institution system, which shows the list of insured persons working in the workplace or workplaces where the foreign person is the owner or partner.
• Up-to-date letter from the Revenue Administration system showing the tax debt status of the workplace or workplace where the foreign person is the owner or partner
• Up-to-date letter obtained from the SSI Social Security Institution system showing the social security premium debt status of the workplace or workplaces where the foreign person is the owner or partner.
• In the administrative audits carried out by public institutions, the statement regarding whether the company has been fined within the last 6 months must be in writing, if the penalty has been received, the relevant documents must be attached.

Employment and Citizenship Information Form

The Ministry evaluates whether the share of capital and share in the companies and / or companies in which the real person of foreign nationality is the owner or partner is at a sufficient level for the application.

In the examination of the applications, the continuity status of the Turkish citizens working full time in the last 6 (six) months period is taken into consideration.

Regarding the applicants whose application was made with false or misleading information or documents, the Ministry is notified of the issue to the Ministry of Interior in order to ensure that the necessary actions are taken.
