Acquisition of Turkish Citizenship by Marriage for German Citizens

Article 16 of the Turkish Citizenship Law No. 5901 includes the conditions for acquiring Turkish citizenship by marriage. This law and the regulation regarding the implementation of the law contain the citizenship application conditions, procedures and principles for German nationals who are married to a Turkish citizen.

Conditions of Acquiring Turkish Citizenship by Marriage for German Citizens

Firstly, marrying a Turkish citizen does not directly entitle the German national to become a Turkish citizen. Marriage does not give a German national the right to reside in Turkey. These are all separate processes and must be managed properly. The conditions for acquiring Turkish citizenship by marriage are regulated in Article 16 of the Citizenship Law No. 5901. In accordance with the text of the relevant law, the German national must meet the following conditions in order to become a citizen through his/her Turkish citizen spouse:

• The German national who will apply for Turkish citizenship must have remain married to a Turkish citizen for at least 3 years and this marriage must continue.
• Spouses must live in a family union.
• The German national must not be engaged in activities contrary to the marriage union.
• The German national must not be in a situation that threatens public safety.

German nationals can apply for citizenship to the governorships in their settlements if they meet the above conditions. In the event that the Turkish citizen spouse dies after the application, the condition in the second order above, that is, the spouses living in a family union, is not sought. The foreign person can become a Turkish citizen if he/she fulfills the other conditions. However, foreign persons who acquire Turkish citizenship by marriage, if the marriage is decided to be annulled, if they separate amicably, they will continue to retain their Turkish citizenship.
